SILENT DISCO UNDER THE STARS TERMS AND CONDITIONS, INDEMNITY & WET WEATHER INFORMATION.
By completing your purchase and booking your tickets, you accept the terms and conditions set out below.
TERMS AND CONDITIONS
- Tickets & transfers
Silent Disco Under the Stars tickets are not transferable to another person without prior written permission from Lights Out And Dance. To request a transfer, email dance@lightsoutanddance.com. - Early Bird tickets
Early Bird tickets are non-refundable for change of mind, change of plans or inability to attend. This does not affect any rights you may have under the Australian Consumer Law or other applicable legislation. - Refunds
Tickets purchased outside of the Early Bird release may be eligible for a partial refund where the refund request is received at least 2 days before the event. Refund requests received within 2 days of the event will not be accepted. - Refund administration fee
Credit card and booking fees are non-refundable. A 30% administration fee per ticket will be deducted from the ticket price when processing an eligible refund. The remaining 70% of the ticket price will be refunded, less any non-refundable credit card or booking fees. - Refund deadline
No refunds will be provided within 2 days of the event, including cancellations made on the day of the event. - No-shows
No-shows and cancellations on the day of the event are not eligible for a refund or ticket transfer. - Headset care
You are responsible for the care of the Silent Disco headsets that are provided to you. They must be returned at the end of the event, clean and in the same condition they were provided to you. - Headset restrictions
You are not permitted to take Silent Disco headsets into the water, place them on the sand or take them away from the event. - Face paint & glitter
Face paint and glitter are not permitted due to the potential damage they can cause to our headsets. Anyone with face paint and/or glitter in their hair will not be issued headsets. - Cube Lights
Cube lights are used at the event to identify the designated dancing area and provide ambient lighting. Participants must not stand, sit, dance on, move, lean on or place bags or other belongings on the glow light cubes. Participants must follow any instructions from the event crew or security personnel regarding the placement and use of these lights. - Designated dance area
All attendees are required to stay within the designated Silent Disco dancing space as directed by your host for the entire duration of the event unless attending the amenities or departing early. - Booking tickets for others
By purchasing a ticket on behalf of another individual, you confirm that you have obtained their explicit authorisation to accept these Terms and Conditions and the Indemnity of Liability below on their behalf. You acknowledge that your acceptance of these Terms and Conditions and the Indemnity of Liability is intended to bind that person to these terms as if they had accepted them themselves. - Booking for friends & indemnity
You agree to indemnify and hold harmless Lights Out And Dance, its owner, volunteers, crew, contractors and representatives from any claim, demand, action, damage, liability, cost or expense arising out of or related to your booking of event tickets on behalf of another person. - Free-movement dancing
Silent Disco Under the Stars is a free-movement, no-contact dancing session – sorry, no dirty dancing lifts permitted. - Outdoor environment
You acknowledge that Silent Disco Under the Stars events take place outdoors in dark environments, including parks, beaches, and natural earth which may be uneven ground and not a dance floor. - Footwear & safety
Participants agree to take care and wear appropriate footwear to ensure their safety during the event. - Drug & alcohol-free event
Silent Disco Under the Stars is a drug and alcohol-free dance event. If your host reasonably suspects that you are intoxicated and/or under the influence of illicit drugs, you will be refused entry to the session, and your ticket will not be refunded. - Children
Children are permitted to attend Silent Disco Under the Stars events with a parent or guardian ticketholder. - Supervision of children
Children must be supervised at all times and not left unattended at the event. - Photography & videography
There will be event photographers and videographers. All footage captured may be used for marketing purposes for future Silent Disco events by the event hosts. - Physical activity
The event involves physical activity, and participants attend at their own risk. The participant is responsible for ensuring that they are medically fit to undertake physical activity. If in doubt, please consult your doctor before attending the event. - Fire-twirling
Fire-twirling is strictly prohibited within any event dance area. - Cancellation or postponement
The event may be cancelled or postponed at short notice due to unforeseen circumstances outside of our control. In such cases, the organisers will post immediately on their social media and notify participants via email and/or SMS with as much notice as possible. Participants who book tickets for friends are solely responsible for updating them if they do not provide their contact details when booking.
If the event is postponed:
Tickets will automatically be transferred to the rescheduled event date. Participants who are unable to attend the rescheduled event date may request a refund. All refund requests must be made in writing within 3 days of the announcement of the rescheduled event date. Refund requests received after this period will not be accepted, except where otherwise required by Australian Consumer Law or other applicable legislation.
If the event is cancelled:
Participants will be notified of the cancellation, and eligible ticket holders will receive a refund in accordance with applicable Australian Consumer Law and other relevant legislation. Details of the refund process will be provided to ticket holders at the time of cancellation. Rescheduling
While the event hosts will do everything within their power to reschedule a cancelled or postponed event, if this is not able to be rescheduled to another night during the SWELL Sculpture Festival, and participants cannot attend a rescheduled event, tickets will be refunded in accordance with the applicable refund arrangements.
INDEMNITY OF LIABILITY
- By purchasing a ticket to participate in Silent Disco Under the Stars, you acknowledge and accept that the event takes place outdoors in a natural environment and that you participate at your own risk.
- By purchasing a ticket on behalf of another individual, you confirm that you have obtained explicit authorisation from the person to accept these terms and conditions and the indemnity of liability below on their behalf and hold harmless the hosts and their representatives from any claims, damages, liabilities, and losses.
- You understand and agree that the organisers of the event are not responsible for any injury, loss, or damage that you may suffer as a result of your participation in the event, including but not limited to any injury or harm that may result from collisions with other participants, tripping or falling, or any other accident or mishap that occurs during the event.
- You agree to indemnify and hold harmless the organisers, their team (both paid and voluntary) and their affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising out of or in connection with your participation in the event, including but not limited to any personal injury, harm, property damage, or any other loss you may suffer as a result of your participation, own actions, or omissions during the event. This indemnity shall survive the termination of your participation in the event.
- You further acknowledge and agree that you are solely responsible for your own safety during the event and that you will follow all rules outlined here, instructions and requests given during the event and take all necessary precautions to avoid injury, including but not limited to wearing appropriate clothing and footwear to participate in the event.
- By booking your ticket and participating in the Silent Disco Under the Stars event, you confirm that you have read and understood this indemnity clause, and that you agree to be bound by its terms and conditions.
WET WEATHER CONTINGENCY
RAIN, RESCHEDULING & NOTIFICATIONS
Rain is the ultimate nemesis of all outdoor event managers – and it’s the one thing we have absolutely no control over.
Silent disco headsets and DJ equipment cannot be used in wet weather. If rain is forecast, or conditions are considered too risky for the equipment, the event may need to be postponed.
We monitor conditions closely in the days leading up to the event and on event day. If rain is predicted, or the equipment provider we hire headsets from deems conditions too risky for their equipment, we’ll make the call. And yep, after all the hard work that goes into the event, we’ll be gutted too.
📲 HOW WE’LL LET YOU KNOW
If we need to postpone, we’ll notify ticket holders via SMS and email no later than 6 PM on the day of the event.
We’ll also post updates on Facebook and Instagram, so keep an eye on socials too.
NO NEWS = GOOD NEWS. IF YOU DO NOT HEAR FROM US, WE ARE DANCING!
☔ RESCHEDULED EVENTS
If we have to hit pause, we’re committed to rescheduling as soon as possible – usually the following weekend or within a few weeks.
Your tickets will automatically transfer to the new date – no need to rebook.
If you cannot attend the rescheduled date, you may request a refund. All refund requests must be made in writing within 3 days of the announcement of the rescheduled event date.
For refunds resulting from an event postponement or cancellation by the organisers, the 30% administration fee will not apply. Booking and credit card fees remain non-refundable, except where otherwise required by Australian Consumer Law or other applicable legislation.
📣 BOOKING FOR FRIENDS?
If you didn’t include your friends’ contact information at checkout, please pass on any updates to them. We can only notify those whose information has been provided at the time of booking.
🧘 RESPECTING THE CALL
Nobody’s more disappointed than us when the weather doesn’t play nice. These events are a huge labour of love – and we only postpone when absolutely necessary, to protect our crew, our gear, and your safety.
We have a strict no-abuse policy.
Verbal, written or online abuse will not be tolerated – ever.
